Use of the Welsh Language in Courts | Defnydd o’r Iaith Gymraeg mewn Llysoedd

Tara Swaminathan and Lowri Roberts take a look at how the HM Courts and Tribunals Service account for Welsh language needs when it provides services to the public in Wales.

A revised version of the Welsh Language Scheme was approved and published in March this year. The scheme sets outs how the HM Courts & Tribunal Service aims to treat Welsh and English languages equally.

The Welsh Language Act 1993 states that any party, witness or other person has the right to speak Welsh in a court in Wales. It does not, however, provide the right to a Welsh hearing but, in some situations, a case can progress in Welsh where all the parties are bilingual.

It is the duty of the party requesting to speak Welsh to notify the court as soon as it is anticipated that the Welsh language is likely to be used. The arrangements relating to translations will be dependent on the level of understanding of the relevant individuals. A suitably experienced or qualified interpreter will be provided, subject to sufficient notice being given. Court documents are normally translated at the cost of the court, but this is assessed on a case-by-case basis.

 


 

Mae Gwasanaeth Llysoedd a Thribiwnlysoedd Ei Mawrhydi (GLlTEM) wedi mabwysiadu’r egwyddor y byddant yn ystyried anghenion yr iaith Gymraeg pan fyddant yn darparu gwasanaethau i’r cyhoedd yng Nghymru.

Cafodd fersiwn diwygiedig o’r Cynllun Iaith Gymraeg ei gymeradwyo a’i gyhoeddi ym mis Mawrth eleni. Mae’r cynllun yn nodi sut y mae GLlTEM am geisio trin yr iaith Gymraeg a’r iaith Saesneg yn gyfartal.

Mae Deddf yr Iaith Gymraeg 1993 yn datgan bod gan unrhyw unigolyn, tyst neu berson arall, yr hawl i siarad Cymraeg mewn llys yng Nghymru. Nid yw, fodd bynnag, yn rhoi’r hawl i wrandawiad Cymraeg ond, mewn rhai sefyllfaoedd, gall achos ei gynnal yn Gymraeg lle mae’r unigolion i gyd yn ddwyieithog.

Mae’r dyletswydd i hysbysu’r llys fod yr iaith Gymraeg am gael ei ddefnyddio ar yr unigolyn sy’n gwneud y cais. Bydd trefniadau y chyfieithiadau yn dibynnu ar safon dealltwriaeth yr unigolion perthnasol. Bydd cyfieithydd â phrofiad neu gymhwyster addas yn cael ei darparu, ar yr amod ar roi ddigon o rybudd. Mae dogfennau’r llys, fel arfer, yn cael eu cyfieithu ar gost y llys, ond caiff hyn ei asesu ar sail pob achos unigol.
