Digital justice: a force for good? | Cyfiawnder digidol: grym er daioni?

The legal landscape in Wales is changing. As digital technology becomes more and more advanced, it has the potential to be a force for good in law. Article by Guto Llewelyn and Tara Swaminathan.

The Legal Innovation Lab will be a unique research and innovation hub, making it easier for people to access legal advice and creating business opportunities in the legal technology sector in Wales. The Lab, which will be based at Swansea University, will open next summer with the aim to open a clear route towards universal access to justice. Academic and industry experts alike will also look for innovative ways to reduce the risk of data hacking, and use technology such as artificial intelligence to counteract cyber threats.

This comes in the wake of the recent ‘Justice Commission in Wales’ report published last week, which identified opportunities to strengthen the legal sector in Wales. By providing the facilities to discover the potential of emerging technologies, it is hoped that the Legal Innovation Lab will assist law firms at the intersection of law and technology and enable professional bodies to develop and promote the technological capabilities of the legal sector.

The Legal Innovation Lab shows that the goalposts have been moved – technology can be used to make meaningful changes to legal aid, the law-making process in Wales and the contribution of the legal sector to the Welsh economy overall. For example, the digitalisation of legal services will, at best, increase certain individuals’ accessibility to legal justice.

However, in order to meet the needs of all citizens, technology must be used as part of a wider, holistic approach to the legal landscape. Using emerging technologies to work with communities, organisations and experts across Wales will help lawmakers understand the roadblocks citizens face, and on how any such hurdles may be overcome.

Mae tirwedd gyfreithiol Cymru yn newid. Wrth i dechnoleg ddigidol ddod yn fwyfwy datblygedig, mae ganddo’r potensial i fod yn rym da yn y gyfraith.

Bydd y Labordy Arloesi Cyfreithiol yn ganolbwynt ymchwil ac arloesi unigryw, a fydd yn ei gwneud yn haws i bobl gael gafael ar gyngor cyfreithiol, ac yn helpu i greu cyfleoedd busnes yn y sector technoleg gyfreithiol yng Nghymru. Bydd y Lab, a fydd wedi’i leoli ym Mhrifysgol Abertawe, yn agor haf nesaf gyda’r nod o agor llwybr clir tuag at fynediad cyfun at gyfiawnder. Bydd arbenigwyr academaidd a diwydiant hefyd yn chwilio am ffyrdd arloesol o leihau’r risg o hacio data, ac o ddefnyddio technoleg fel deallusrwydd artiffisial i wrthweithio bygythiadau seiber.

Daw hyn yn sgil yr adroddiad diweddar ‘Justice Commission in Wales’ a gyhoeddwyd y mis diwethaf, a nododd gyfleoedd i gryfhau’r sector cyfreithiol yng Nghymru. Trwy ddarparu’r cyfleusterau i ddarganfod potensial technolegau sy’n dod i’r amlwg, y gobaith yw y bydd y Lab yn cynorthwyo cwmnïau cyfreithiol ar groesffordd y gyfraith a thechnoleg, ac yn galluogi cyrff proffesiynol i ddatblygu a hyrwyddo galluoedd technolegol y sector cyfreithiol.

Dengys y Lab bod y pyst gôl nawr wedi’u symud – gellir defnyddio technoleg i wneud newidiadau ystyrlon i gymorth cyfreithiol, i’r broses ddeddfu yng Nghymru, ac i gyfraniad y sector cyfreithiol i economi Cymru yn gyffredinol. Er enghraifft, bydd digideiddio gwasanaethau cyfreithiol, ar y gorau, yn cynyddu hygyrchedd rhai unigolion i gael cyfiawnder cyfreithiol.

Serch hynny, er mwyn diwallu anghenion pob unigolyn, mae’n rhaid defnyddio technoleg fel rhan o agwedd ehangach a gyfannol tuag at y dirwedd gyfreithiol. Bydd defnyddio technolegau sy’n dod i’r amlwg i weithio gyda chymunedau, sefydliadau ac arbenigwyr ledled Cymru, yn helpu deddfwyr i ddeall y rhwystrau y mae eu dinasyddion yn eu hwynebu, ac i ddeall sut y gellir goresgyn unrhyw rwystrau o’r fath.
