Ben Dalton

Ben Dalton joined Capital Law in March 2018 and has over ten years’ litigation experience, both in a commercial and property context.

Ben has extensive experience in property related disputes including landlord & tenant, Party Wall Act and boundary issues. Ben had recent success in the First-tier Tribunal (Property Chamber) in an application involving adverse possession following a neighbour’s decision to annex a large portion of the applicants’ front garden; Clewer & Clewer v Scammell [2018] UKFTT 209 (PC).

Ben has also acted for both insurance companies and their policy holders in securing damages following perils such as fire, flood and subsidence as well as providing advice on policy coverage issues.

In addition, Ben has successfully pursued claims on behalf of utilities providers, such as water and energy companies, following damage to their underground apparatus.
