Commercial Disputes

Mark is an Associate in our Commercial Disputes team. He joined Capital in September 2019 from the London office of a global law firm headquartered in the US.

Mark has experience in all forms of business disputes and has represented multinational corporations, SMEs and high net worth individuals in domestic and global commercial litigation, arbitration and mediation. He also has experience of acting in contentious international trusts matters, including in England and Wales, the Cayman Islands, the Isle of Man and Gibraltar.

Mark has always maintained a lively pro-bono practice. He has assisted Amicus ALJ in final appeals for clemency in US death row cases. For the past 5 years, Mark has also accepted referrals from Macmillan Cancer Care to advise cancer patients (and former patients) and their carers in respect of their employment and other statutory labour rights.

  • Acting on behalf of the beneficiary of a number of large, offshore property trusts in a complex, multijurisdictional trusts dispute.
  • Acting on behalf of a private airline in respect of nuisance claims for breach of contract and quantum meruit brought by former investment banking partners.
  • Acting on behalf of a brand licensee in separate but related LCIA proceedings regarding a German property and hospitality development.
  • Acting on behalf of an alcoholic beverage manufacturer in a high-value dispute with its UK distributor relating to bonus entitlement and unpaid purchase monies and distribution fees.
  • Advising on breach of warranty claims under an agreement for the sale and transfer of a multi-million pound book of non-performing loans, including representing client at mediation.
  • Advising the former majority owner of a Championship football club as to the recovery of unpaid consideration for the sale of the shares in the club.
  • Advising the ultimate beneficial owner of a multi-million pound property empire in respect of enforcement proceedings in various European and US jurisdictions brought by one of the developer’s major funders.
  • Advising on a stakeholder action in the English High Court issued by the subject of various conflicting overseas and domestic UK judgments.
  • Advising a leading manufacturer of aircraft in relation to a dispute with a national carrier in the Middle East.
  • Acting in a complex multi-jurisdictional dispute concerning a joint venture for the redevelopment of a Caribbean island.
  • Acting on behalf of the joint dissolution trustees of a BVI-based mega-fund active in Eastern Europe and the Balkans.
  • Assisting a client in a high-value joint venture deadlock dispute relating to the funding of the operational group (which was engaged in the redevelopment of a Caribbean island).
